Terms of Use

1. Acceptance

By accessing or using The Fertility Link (“the Service”), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to create an account or submit an inquiry. By using the Service, you represent that you meet this requirement.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at security@thefertilitylink.com of any unauthorized use.

4. The Service

The Fertility Link provides:

• A directory of fertility clinics in Canada and the United States with profile information, costs (estimates), and contact details collected from public sources.
• A navigation tool ("Navigator") that generates personalized roadmaps based on your inputs.
• A lead-capture feature that lets you send an inquiry to a specific clinic of your choice. Inquiries are delivered to the clinic and stored in your in-app inbox.
• Educational articles about fertility-related topics.

What the Service is not: it is not a medical service, not a referral service, not a treatment recommendation, and not a substitute for consultation with qualified healthcare providers. Clinics are not endorsed by The Fertility Link by virtue of being listed.

5. Acceptable use

You agree not to:

• Submit false, misleading, or inflammatory information.
• Impersonate any person, including a clinic representative.
• Use the Service to send spam, harass clinics, or submit inquiries on behalf of others without their consent.
• Scrape, harvest, or systematically download Service content.
• Attempt to gain unauthorized access to other users' accounts or to our systems.
• Use the Service to violate any applicable law or regulation.

6. Clinic information accuracy

We compile clinic information from public sources and from claimed clinic submissions. We make reasonable efforts to keep listings accurate but cannot guarantee accuracy, completeness, or currency. Always verify costs, services, waitlists, and eligibility directly with the clinic before relying on this information for decisions.

7. Inquiries you send

When you submit an inquiry to a clinic, you authorize us to (a) deliver the inquiry contents to the specific clinic you select and (b) retain a copy in your in-app inbox. The clinic, once they verify their listing, can see and respond to your inquiry. Your inquiry remains in your inbox until you delete it or 24 months of inactivity have passed (after which contents are anonymized; see Privacy Policy).

8. Intellectual property

The Service, including text, layouts, branding, and code (excluding clinic-supplied content), is owned by The Fertility Link and protected by applicable copyright and trademark law. You may share links to Service pages and quote brief excerpts for non-commercial purposes with attribution. You may not reproduce, redistribute, or build derivative directory products from our content.

9. Termination

You may close your account at any time by contacting hello@thefertilitylink.com. We may suspend or terminate accounts that violate these Terms, with or without notice.

10. Disclaimer of warranties

The Service is provided “as is” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

11. Limitation of liability

To the maximum extent permitted by law, The Fertility Link and its affiliates are not liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any direct damages is limited to the amount you paid us in the 12 months preceding the claim (or, for free users, to CAD $100).

12. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-laws principles. Any disputes will be resolved in the courts of Ontario, except where this would conflict with mandatory consumer-protection laws in your jurisdiction of residence.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated to registered users by email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
